These Terms and Conditions apply to quotations, bookings, goods and plumbing services supplied by MMJ Plumbing, ABN 48 165 440 424, and to use of the MMJ Plumbing website.
By accepting a quotation, making a booking, authorising work, paying a deposit, allowing work to commence or using this website, you agree to the applicable parts of these Terms and Conditions.
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot lawfully be excluded under the Australian Consumer Law, the Home Building Act 1989 (NSW) or any other applicable law.
Trade Terms & Conditions
1. Application of Trade Terms
These Trade Terms apply to each quotation, booking, order, supply of goods and provision of services by MMJ Plumbing unless a separate written agreement expressly states otherwise.
They apply to residential customers, property owners, landlords, authorised tenants, real estate agents, strata managers, owners corporations, businesses and commercial customers.
If there is an inconsistency, mandatory law prevails, followed by any signed formal contract, the accepted written quotation, these Terms, and then general website information.
Regulated residential building work: where NSW law requires a prescribed written contract, progress-payment schedule, insurance information, cooling-off notice or other documentation, that mandatory documentation will apply. These website Terms do not replace a contract required by law.
2. Definitions
- Customer means the person or entity requesting, ordering or authorising the Goods or Services.
- Contract means the agreement comprising the accepted quotation or booking, these Terms and any other document expressly incorporated into the agreement.
- Goods means fixtures, fittings, appliances, components, equipment and materials supplied by MMJ Plumbing.
- Services means plumbing, drainage, gas, hot-water, diagnostic, maintenance, installation, repair and related services.
- Site means the property or location where Goods or Services are supplied.
- Quote means a written quotation issued by MMJ Plumbing.
- Price means the amount payable for Goods and Services, including approved variations, fees and GST unless stated otherwise.
- Variation means a change to the scope, method, Goods, timing or Price.
- MMJ Plumbing, we, us or our means MMJ Plumbing, ABN 48 165 440 424.
3. Acceptance and Authority
The Customer accepts these Terms by signing or accepting a Quote, making a booking, paying a deposit, authorising work verbally or in writing, or allowing MMJ Plumbing to commence work.
The person authorising the work warrants that they own the Site or have authority from the owner or responsible entity to engage MMJ Plumbing. Where more than one person is named as Customer, each is jointly and severally responsible for the Customer’s obligations.
MMJ Plumbing may accept or decline a booking or order at its reasonable discretion.
4. Quotations and Pricing
Unless stated otherwise, a written Quote is valid for seven days from the date of issue. After that period, MMJ Plumbing may withdraw or revise it.
A Quote is based on information available at the time, reasonably visible and accessible Site conditions, the stated scope and the assumption that no concealed, unsafe, defective or unusual condition materially affects the work.
Unless expressly included, a Quote excludes hidden defects, unrelated rectification, asbestos removal, specialist reports, authority fees, permits, traffic control, unforeseen excavation, and restoration by other trades.
All prices include GST unless clearly stated otherwise. An estimate is indicative only and the Customer must pay the reasonable actual cost of work and Goods supplied.
5. Call-Out Fees and Inspection
MMJ Plumbing may charge a call-out fee for attending the Site, carrying out an initial assessment and providing advice or fixed pricing.
The call-out fee remains payable where the Customer does not proceed, the issue requires further testing, access is unavailable or unsafe, the fault is outside our responsibility, or the Customer cancels after attendance.
After inspection, MMJ Plumbing will generally provide a fixed price for the identified scope. That price applies only to the stated scope and assumptions.
6. Deposits
MMJ Plumbing may require a deposit of 10% of the final agreed quotation before ordering Goods, allocating labour or commencing work.
The deposit is credited against the final Price. If the Customer cancels, MMJ Plumbing may apply the deposit toward work performed, Goods ordered, supplier charges, scheduling costs and other reasonable loss, subject to applicable law.
Any refundable balance remaining after lawful deductions will be returned to the Customer.
7. Payment Terms
Unless different written terms are approved, payment is due immediately upon completion. MMJ Plumbing may issue progress invoices for completed stages, Goods supplied or approved Variations.
Accepted methods may include bank transfer, EFTPOS, Visa, Mastercard, Apple Pay, Google Pay and cash. Payment is received only when cleared funds are available.
The Customer must not withhold or set off payment unless authorised by law or agreed in writing. Any undisputed amount remains payable by the due date.
8. Commercial Customers and Approved Accounts
Commercial customers, strata managers, real estate agencies and approved account customers may receive different payment terms where agreed in writing.
MMJ Plumbing may review, suspend or withdraw credit terms if an account becomes overdue, a limit is exceeded, the Customer’s financial position materially changes or these Terms are breached.
9. Overdue Accounts and Debt Recovery
If an invoice is not paid when due, MMJ Plumbing may suspend further Services, decline additional bookings and refer the account to a debt collection agency or solicitor.
Subject to applicable law, interest may be charged at 2.5% per month on the overdue balance, calculated from the due date until payment, or at the maximum lawful rate if lower.
The Customer must reimburse reasonable debt-recovery, court and legal costs properly incurred in recovering an overdue amount, to the extent permitted by law.
10. Variations and Additional Work
A Variation may be required where the Customer changes the scope, additional defects are identified, different Goods are required, Site conditions differ from those reasonably apparent, or an authority imposes an additional requirement.
Where practicable, MMJ Plumbing will explain the proposed Variation and additional price before proceeding. A Variation may be authorised by signature, email, text message, electronic acceptance, verbal approval or another clear instruction.
If necessary additional work is not approved, MMJ Plumbing may suspend the Services, make the Site reasonably safe and invoice for work and Goods supplied up to that point.
11. Emergency and Protective Work
MMJ Plumbing may identify urgent work required to prevent flooding, property damage, contamination, injury or an unsafe plumbing, gas or hot-water condition.
We will seek approval where reasonably practicable. If the Customer cannot be contacted and immediate action is reasonably necessary, MMJ Plumbing may carry out limited work to isolate, contain or make the situation reasonably safe.
The Customer must pay the reasonable cost of authorised emergency work and necessary protective work.
12. Hidden, Unforeseen and Existing Conditions
Plumbing and drainage systems may contain conditions that cannot be identified until work begins or further testing is performed.
- Collapsed, cracked, displaced or incorrectly graded pipework.
- Tree-root intrusion, corrosion or concealed leaks.
- Previous temporary repairs or non-compliant installations.
- Services hidden behind walls, floors, cabinetry, concrete or landscaping.
- Asbestos, mould, contamination or hazardous material.
- Undocumented utilities, cables, pipes or structural elements.
- Defective infrastructure or equipment outside the quoted scope.
MMJ Plumbing is not responsible for a pre-existing defect merely because it becomes apparent during the Services. Additional investigation, labour, Goods, specialist work and rectification will be treated as a Variation.
MMJ Plumbing may refuse to disturb suspected asbestos or hazardous material until it has been assessed and managed by an appropriately qualified provider.
13. Customer Responsibilities
- Provide complete and accurate information about the problem and Site.
- Disclose known hazards, asbestos, concealed services and previous repairs.
- Ensure the person authorising work has authority to do so.
- Provide water, electricity and facilities reasonably required.
- Remove or protect valuables, furniture and fragile items.
- Keep children, pets and other persons away from the work area when requested.
- Follow reasonable safety, operating and maintenance instructions.
- Promptly notify MMJ Plumbing of any concern.
The Customer is responsible for reasonable loss or additional cost caused by inaccurate information, undisclosed hazards, unavailable access or failure to comply with these obligations.
14. Site Access and Safety
The Customer must provide safe, clear and reasonable access at the agreed time, including access to gates, driveways, plant rooms, cupboards, roof spaces, subfloors and service locations.
If access is unavailable, delayed, obstructed or unsafe, MMJ Plumbing may suspend work, leave the Site, charge a call-out or waiting fee and reschedule subject to availability.
MMJ Plumbing may refuse to work where there is aggressive behaviour, uncontrolled animals, suspected hazardous material, exposed electrical risk, unsafe structures or another unacceptable hazard.
15. Property Authority, Approvals and Strata Consent
Unless expressly included in the Quote, the Customer is responsible for obtaining all required permissions and approvals from the owner, landlord, owners corporation, strata committee, property manager, council, authority, utility provider or insurer.
The Customer warrants that required approval has been obtained before work begins. Additional attendance or delay caused by missing approval may be charged to the Customer.
16. Scheduling, Attendance and Delays
Appointment and completion times are estimates unless expressly confirmed as fixed in writing. Emergency call-outs, traffic, weather, access, diagnostic findings, supplier availability and earlier jobs may affect timing.
MMJ Plumbing will take reasonable steps to attend and complete the Services within the advised timeframe but does not guarantee an exact arrival or completion time.
17. Customer Cancellations
The Customer should notify MMJ Plumbing as soon as possible if they wish to cancel or postpone.
If cancellation occurs after attendance, work has commenced, labour has been allocated or costs have been incurred, the Customer must pay the call-out fee, work completed, Goods ordered or supplied, supplier charges, reasonable safety work and other reasonable direct loss, subject to applicable law.
This clause does not restrict any statutory cooling-off or cancellation right.
18. Hot Water Systems and Special-Order Goods
Some hot-water systems, fixtures, fittings and components are ordered specifically for the Customer or Site.
Once ordered, the Customer may be responsible for the supplier price, freight, cancellation or restocking charges and non-returnable Goods. A deposit may be non-refundable to the extent MMJ Plumbing has incurred an unrecoverable cost, subject to law.
If an item becomes unavailable, MMJ Plumbing may propose a reasonably comparable substitute but will obtain approval before supplying a materially different item.
19. Customer-Supplied Goods and Materials
Where MMJ Plumbing agrees to install customer-supplied Goods, the Customer is responsible for ensuring they are suitable, complete, undamaged, compliant and compatible.
MMJ Plumbing may refuse to install Goods that appear unsafe, defective, incomplete, non-compliant or unsuitable.
MMJ Plumbing does not provide a product warranty for Goods it did not supply and is not responsible for product faults, missing components, manufacturer defects or additional labour caused by those matters. MMJ Plumbing remains responsible for the quality of its own installation work.
20. Ownership, Title and Risk in Goods
To the extent permitted by law, legal title to Goods supplied by MMJ Plumbing remains with MMJ Plumbing until all amounts owing for those Goods and related Services are paid in full.
Risk passes to the Customer when Goods are delivered to the Site, installed or placed under the Customer’s control, whichever occurs first.
This clause does not authorise removal where removal would be unlawful, unsafe or cause unreasonable property damage.
21. Completion and Site Condition
Services are substantially complete when the agreed scope has been performed and the relevant installation or system is reasonably available for its intended use, despite minor outstanding items that do not prevent use.
Unless quoted otherwise, MMJ Plumbing will remove waste generated directly by its work and leave the immediate area reasonably tidy.
Professional cleaning, painting, tiling, plastering, carpentry, cabinetry, landscaping, specialist restoration and exact matching of aged finishes are excluded unless expressly included.
22. Blocked Drains and Drain-Clearing Services
A blockage may result from roots, cracks, collapse, displacement, poor fall, grease, sanitary products, foreign objects, deterioration or inadequate design.
Clearing a blockage restores flow at the time of service but does not necessarily repair the underlying cause. Unless permanent rectification is included, MMJ Plumbing does not guarantee that the drain will not block again.
CCTV inspection, excavation, repair, replacement, relining or root treatment is additional unless included in the Quote. A recurring blockage alone does not establish that the original drain-clearing service was defective.
23. Equipment Lodged in Defective Drains
Drain-cleaning or inspection equipment may become lodged or damaged in collapsed, broken, displaced or severely deteriorated drains.
If equipment becomes lodged because of a pre-existing drain defect, the Customer must pay the reasonable recovery cost, including labour, excavation, access, specialist assistance and reinstatement. The Customer is not responsible to the extent the issue was caused by MMJ Plumbing failing to exercise due care and skill.
24. Photographs, Videos and Service Records
The Customer authorises MMJ Plumbing to take reasonable photographs, videos and diagnostic recordings of the work area, existing defects, inspections, Goods, work in progress and completed work.
Records may be used for quoting, job documentation, quality assurance, training, warranty assessment, insurance, compliance and dispute resolution.
Identifying images will not be used publicly without consent. De-identified project images may be used for business or promotional purposes where the Customer and exact property cannot reasonably be identified, unless the Customer asks us not to do so.
25. Workmanship and Product Warranties
MMJ Plumbing provides a 12-month workmanship warranty from completion for defects caused by MMJ Plumbing’s workmanship, unless a longer period is stated in writing.
This voluntary warranty is additional to, and does not replace, rights under the Australian Consumer Law or statutory warranties applying under NSW law.
Manufacturer warranties apply to eligible Goods supplied by MMJ Plumbing in accordance with the manufacturer’s conditions. Where appropriate, MMJ Plumbing will provide reasonable assistance with a manufacturer claim.
The workmanship warranty does not cover:
- Normal wear and tear or routine maintenance.
- Misuse, neglect, accidental damage or unauthorised alteration.
- Pre-existing, concealed or unrelated defects.
- Blockages caused by roots, foreign objects, grease or misuse.
- Failure of customer-supplied Goods.
- Damage caused by another contractor or person.
- Events outside MMJ Plumbing’s reasonable control.
Australian Consumer Law: our Goods and Services come with guarantees that cannot be excluded. Nothing in this document limits any remedy available where a consumer guarantee has not been met.
26. Defect Notification and Opportunity to Inspect
The Customer should notify MMJ Plumbing promptly after discovering a concern and provide reasonable details, photographs and access for inspection.
Where legally permitted, the Customer should allow MMJ Plumbing a reasonable opportunity to inspect and, where appropriate, rectify the issue before engaging another provider.
This clause does not require the Customer to delay urgent action needed to prevent injury or further damage, and does not restrict rights under applicable law.
27. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability under the Australian Consumer Law.
To the maximum extent permitted by law, MMJ Plumbing is not liable for loss caused by pre-existing defects, inaccurate information, undisclosed hazards, customer-supplied Goods, another contractor, customer misuse, unauthorised alterations or circumstances outside MMJ Plumbing’s reasonable control.
Where liability may lawfully be limited, MMJ Plumbing’s liability will be limited, at its option, to re-supplying the Services, paying the reasonable cost of re-supply, repairing or replacing the Goods, or paying the reasonable cost of repair or replacement.
MMJ Plumbing is not liable for indirect or consequential commercial loss, loss of profit, loss of revenue or loss of opportunity, except where such liability cannot lawfully be excluded.
28. Events Outside Our Reasonable Control
MMJ Plumbing is not responsible for delay or failure caused by events outside its reasonable control, including severe weather, natural disasters, fire, flood, epidemic, industrial action, road closures, utility interruption, supplier failure, material shortages, government action or emergency conditions.
MMJ Plumbing will take reasonable steps to minimise the effect and resume performance when practicable. Time for performance will be extended by a reasonable period.
29. Suspension and Termination
MMJ Plumbing may suspend or terminate the Contract if the Customer fails to pay, denies safe access, gives a direction that would be unlawful or unsafe, materially breaches these Terms, becomes insolvent or behaves abusively toward workers.
On suspension or termination, the Customer must pay for work performed, Goods supplied or ordered, approved Variations, safety work and reasonable costs incurred up to that date.
Termination does not affect rights or obligations accrued beforehand.
30. Complaints and Dispute Resolution
If a concern arises, the Customer should contact MMJ Plumbing promptly and provide relevant details. Both parties agree to make a genuine effort to resolve the matter directly and in good faith.
If the dispute cannot be resolved, either party may use any available complaint, mediation, tribunal or court process. Nothing in this clause prevents urgent legal relief or restricts a consumer’s statutory rights.
Website Terms of Use
31. Acceptance and Permitted Website Use
These Website Terms govern access to the MMJ Plumbing website, including its pages, forms, written content, images and other materials.
You may use the website for lawful purposes such as learning about Services, contacting us, requesting a booking or submitting an enquiry.
You must not submit false information, impersonate another person, introduce malicious code, attempt unauthorised access, scrape website content without permission, interfere with website operation or use the website unlawfully.
32. Website Information
Website information is general and promotional. It is not a site-specific assessment, quotation, diagnosis or guarantee.
Prices, timeframes, availability and service descriptions are indicative unless confirmed in a written Quote or booking confirmation.
While reasonable care is taken, MMJ Plumbing does not warrant that all website information is complete, current or suitable for every circumstance.
33. Intellectual Property
Unless stated otherwise, website content, branding, logos, text, photographs, graphics and page designs are owned by, licensed to or used with permission by MMJ Plumbing.
You may view content for personal and non-commercial use but must not reproduce, republish, modify, distribute, sell or commercially exploit it without written permission.
34. Third-Party Websites and Services
The website may link to third-party maps, payment providers, software platforms or social media services. Those links are provided for convenience.
Unless expressly stated, MMJ Plumbing does not control or endorse those services and is not responsible for their content, availability, security or privacy practices.
35. Website Availability and Security
MMJ Plumbing does not guarantee that the website will always be uninterrupted, secure or error-free. Access may be suspended for maintenance, updates, faults or events outside our control.
To the maximum extent permitted by law, MMJ Plumbing is not liable for loss arising solely from temporary unavailability, reliance on general website information, third-party services or malicious material introduced despite reasonable security measures.
36. Online Enquiries and Bookings
Submitting a form, email or online booking request does not automatically create a confirmed appointment or Contract.
A booking is confirmed only when MMJ Plumbing accepts it by telephone, text message, email or another agreed method.
You are responsible for ensuring that contact details, Site address and other submitted information are accurate. Promotions and online offers are subject to any displayed conditions and cannot be combined unless agreed in writing.
37. Privacy
MMJ Plumbing handles personal information in accordance with its Privacy Policy and applicable privacy laws.
Information may be collected where reasonably necessary to respond to enquiries, arrange bookings, provide Services, issue Xero invoices, process payments, maintain records, manage warranties and recover overdue accounts.
MMJ Plumbing does not intentionally collect website analytics, browser-type information, IP-address data or cookies for analytics based on its current website practices. Third-party services used on the website may operate under their own privacy policies.
38. General Provisions
Changes to these Terms
MMJ Plumbing may update these Terms by publishing a revised version. Changes apply prospectively and do not alter an existing accepted Quote unless agreed or required by law.
Severability
If any provision is invalid or unenforceable, it will be read down to the extent necessary or severed, without affecting the remaining provisions.
No Waiver
A delay or failure to enforce a right is not a waiver of that right.
Assignment
The Customer must not assign the Contract without written consent. MMJ Plumbing may use appropriately qualified employees, subcontractors and suppliers to perform its obligations.
Entire Agreement
The Contract contains the agreement relating to the quoted scope, except for representations or rights that cannot lawfully be excluded.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the courts and tribunals having jurisdiction in New South Wales.
